Dealer. Because its what it would cost you to replace the vehicle. They consider the shape of the car before the wreck also.

Yeah, the insurance company will give you the value of the car before the accident. I'm not sure if they use kbb, nada, or some other???
If the car was hit in the rear and there's previous damage to the front they'll probably deduct money for that.
Mileage, condition (other than what was caused in the accident) and previous accidents could result in a smaller pay out.
At the end of the day it's up to you to make sure you have the proper gap insurance.
I doubt you'll get anything for emotions/stress, you should get any/all hospital bills paid... and of course the towing and rental car!!!
Otherwise it's like Bill says, sh*t happens. Next time you might be the one at fault, accidents are usually just that, accidents.... It happens to the best of us! Forgive and forget...
Hope that helps, Justin.

i got hit a while back im letting my insurance take care of it all unless the other drivers insurance decide to try to screw me on the bodily injury part then its off to court you dont have to deal with his insurance at all they will try to **** you over thats their job so thats why i deal only with my insurance company on this matter
Get yourself a good old fashioned ambulance chaser to deal with this issue if you are not capable of understanding the legal system. They will take 1/3 of your settlement. But at least you know that he will be actually trying to increase your payout, and not looking out for the insurance industry as a whole.
