We are taking him to court IF WE DO NOT GET THE AMOUNT OF MONEY WE NEED FOR A NEW CAR!! Like it or not he should be obligated to pay for what we paid for the vehicle with-in reason so we can get a new one that is similar mileage and shape.

Im not trying to squeeze him for every penny hes worth wow...

Get this into your head. If he pays for auto insurance, he is not personally liable to pay you sh!t. On the other hand, the insurance company is responsible for paying you what the law dictates.

Where do these people come from Bill?

Don't be discouraged by other peoples opinions. Make sure you demand every cent it takes to cover the loss.

Covering the loss is one thing, trying to get anything more than what your entitled to is stupid.

I agree 100%. But I don't think Mithrandir is going for a million. I'm sure he's a fairly level headed person.

I'm going to close this thread if there is any more arguing. Time to take it down a notch.

Opinions expressed, leave it at that.

Its different in every state. In Ohio they basically pay the blue book value on the car. If you owe more than the cars blue book thats your problem. In such cases you SOMETIMES can get a little more.

Pain and suffering is another aspect. You wont get any of it unless you have pain and suffering.

I got $500 for pain and suffering + all medical expenses. The $500 I got for my pain and suffering wasnt nearly enough. I did more suffering latter on missing work and driving to/from my Chiropractor...
