He I believe he would still be eligible for WC if he has to get therapy. Sure he was not hurt on the job but if he has medical appointments in the future that will cut into his job he can apply for some sort of compensation... I'm pretty sure that's what my father did when he was rearended, although his scenario was a bit different since he had a pre-existing condition from an injury working on a job site, that was agitated by the accident.

I think you misunderstand workman's comp, Only applies if injured on the job.

Start by going and getting checked out by your family doctor, and as mentioned get your car inspected by a trusted local shop... If your doctor feels you need further examination and then you will certainly need an attorney.

today was bs i think
im not talking to them directly any more
they said allot of the damage was not caused by the accident they say its impossible because i was hit straight on when you can plainly see the other cars license plate imprinted on the right side of my bumper. the crack door was not cracked but cut they told me so its not their problem.
now i got the medical stuff to deal with too my face is still numb on the left side still in pain. then my dad has problems still too which they said didnt happen
ive been to the e.r. i have an appointment tomorrow with my usual doctor.

Now is when you get a lawyer like immediately and don't say another word to them.

You may also want to contact your own insurance and let them know what the other person's insurance is trying to pull, it's not just their job to insure your vehicle, but also to protect you and your vehicle... the guilty parties insurance doesn't want to have to pay out any more than they have to and will get away with murder if you let them.

Bill I spoke with my Father last night, You and Jon are correct. The only way my father would have gotten compensation was if the settlement that he reached was open ended and not a finalized contract.

My Appologies.

The other insurance company will screw, thats their job. You're insurance company will sit around and let them, because they don't care.

Get a lawyer and make sure you get enough to fix everything, plus a little extra.

Like Bill said, don't try to get an extra 100k or something unless the injuries are going to last a long time, but you have to penalize them enough to let them know they did wrong so they won't do it again. :D
