The guy who towed and has been storing it needs to file a Mechanics Lien against the car. After all he provided a service (towing) and the owner never came back so theres storage.
Since this amount is worth more than the car is, they should just sign the title over to him as he can claim the car.
At which point he has a fresh title to sell you the car.
You can try that old bank, but if they are owed money on it they might tell you to eff off. Technically that car should of been repo'ed long long long ago. If they know where the ca ris they may just repo it now.
The car really isnt this guys to sell, so you could get into trouble for stolen property.
I would have him go for the Mechanics Lien first. Shouldnt be hard to do.
When he first got the car he found the loan papers in the glove box. He called the bank and told them that he had the car and that it was in pieces, but they told him if he wanted the title he'd have to pay off note...

They tried to repo the car sometime afterwards, but they couldnt do so without paying his storage fee's first. (this was about 14 years ok.)

So he doesnt have to turn the car over to the bank without paying him storage, but the bank doesnt have to turn the title over to him unless he wants to pay the note off...

You figure 10 dollars a day (which is well within reason) for the last 14 years would be what 50,000 some of odd dollars.

He said that he isnt interested in trying to get a title, that it would cost him more money to close his shop down for a day to get the proper paper work filled out then the car is worth even with a title...

He said if somebody wanted to buy it for parts he'd sell it, otherwise it will sit there and rot!

Yes thats a low way of doing it... Not to mention highly illegal.

Well Im sure you could part the entire thing out, make a nice drag car or resell it as is.

Maybe you can talk the bank into something... Just act like you bought it and see?

Ya I would talk to the bank about it.
They might work something out with you, they know they'll never get anything out of the current owner, but maybe if you offer to pay something they'll hand the title to you.

Yeah, I'd be willing to pay them a little money, but not pay off a huge amount.

I'm hoping so.

It'd be really nice to have a rust free canvas to start out with...

So how much did they actually still owe on the car not including any interest?
I would find that out, and see if you can work out a deal with the bank.

They don't want the car, what are they going to do with it? They'll never get what's owed on it. So I'm sure if you walk in knowing what's owed, and then offer to pay an amount that's fair, they'll take it.

Heck if the guy who has it is willing to give you a bill of sale that includes the line "storage fees paid in full" (doesn't have to give a price) they may be willing to give you the title just for the title fees too since now obviously you would hold the note on the storage which by far exceeds the amount of the vehicle.
