heres an update
went and got all my yearly refreshers done did oil spill drills spent time in classrooms etc.
neck is still really sore face is still numb on the left side good thing the nerves for feeling and movement are different its just really weird not being able to feel everything
running my dads boat this summer he cant pick fish very well because of his neck and elbow injuries and theyve opened up an area where tons of dog salmon run this year. 7 days til im off to picking 10 thousand pounds of fish a day hopefully
still dealing with the whole bodily injury thing
state farm keeps calling leaving messages wanting to talk to me i think they want to make a deal
but im still going through a lawyer and my insurance those people really pissed me off when i went in for the car damage. looks like my people are gonna get the cost for all the repairs added onto the bodily injury claim somehow.
anyways looks like its all working out i really want the numbness to go away

Back on topic, just contact anybody and everybody you can (except the other persons insurance), if your insurance isn't willing to help you any way they can, then after all this is over with you may want to look into changing your own insurance.

I am going to do my best to get some beer out to you guys... I actually ran out of bottles... But thats hardly an excuse... I'll see if I can send you a sixer of blonde... I'll let you know after the weekend is over. It might be a few weeks as I am in the middle of Fermenting a Oktoberfest in my Chest freezer so all the beer is at 50* and is instant foam when it comes out of the taps... I will def see what I can do with the Blonde though... That just finished fermenting and is probably ready to go into kegs or bottles. The Amber is still kind of dark and gloomy... I dunno what happend with it... I'll have to take a look at the other 15 gallons and see whats up with that... Other than that... My Helles is on tap and pretty damn delicious. And come to think of it I have 2 big wine bottles full of Helles... So i can send on out to you Mike and one out to you bill.. Just shoot me a PM with the adds and I'll send them out.

Funny Lately I have been giving beer out to a lot of ppl... Maybe I should send you some...

I have some Helles on tap and an Amber Ale that hasn't quite cleared yet but I could send some of that too.

I just hate bottling... Thats why I keg...

Lets see here is the list so far of what is going in my brewery:

4 gallons left of Helles
20 Gallons American Amber Ale
30 Gallons of Blonde (Not done but getting close)
6 Gallons of Oktoberfest (Fermenting... Wont be done till You guessed it October)
5 Gallons of Evil Twin Amber Ale Clond (Not mine but I brewed it)

I think next week I will brew an American Wheat that is simialr to a Sam Adams Summer Ale... Who knows...

CaptainPioneer wrote:Jon,

He I believe he would still be eligible for WC if he has to get therapy. Sure he was not hurt on the job but if he has medical appointments in the future that will cut into his job he can apply for some sort of compensation... I'm pretty sure that's what my father did when he was rearended, although his scenario was a bit different since he had a pre-existing condition from an injury working on a job site, that was agitated by the accident.

Here is what it says on workerscompensation.com, notice the bolded section:
What is Workers' Compensation?
Workers' compensation laws provide money and medical benefits to an employee who has an injury as a result of an accident, injury or occupational disease on-the-job. Workers' compensation is designed to protect workers and their dependents against the hardships from injury or death arising out of the work environment. It is intended to benefit the employee and employer alike. The employee receives money (usually on a weekly or biweekly basis) and medical benefits in exchange for forfeiting the common law right to sue the employer. The employer benefits by receiving immunity from court actions against them by the employee in exchange for accepting liability that is limited and determined. The question of negligence or fault is usually not at issue.

So to answer the question, unless the injury occured on the job, there is no way he can make a WC claim.

The other insurance company will screw, thats their job. You're insurance company will sit around and let them, because they don't care.

Get a lawyer and make sure you get enough to fix everything, plus a little extra.

Like Bill said, don't try to get an extra 100k or something unless the injuries are going to last a long time, but you have to penalize them enough to let them know they did wrong so they won't do it again. :D

Bill I spoke with my Father last night, You and Jon are correct. The only way my father would have gotten compensation was if the settlement that he reached was open ended and not a finalized contract.

My Appologies.

You may also want to contact your own insurance and let them know what the other person's insurance is trying to pull, it's not just their job to insure your vehicle, but also to protect you and your vehicle... the guilty parties insurance doesn't want to have to pay out any more than they have to and will get away with murder if you let them.
